Classic Cookie eGift Cards
By purchasing an eGift Card, you agree to our Gift Card Terms and Conditions (listed below). eGift Cards are emailed to recipients within one hour after you place your order or at the designated time you selected. There’s no expiration date or hidden fees on eGift Cards. You can redeem one Classic Cookie eGift Card per order. eGift Cards are not returnable, refundable or redeemable for cash except as required by law. eGift Cards cannot be purchased with coupons, promotional offers or other Chewy eGift Cards. Use eGift Cards to shop on the Site. Sold and delivered by Classic Cookie.
Purchase, acceptance, or use of the Classic Cookie eGift Card means accepting the following terms:
Gift Cards Redemption Redeemable for merchandise and services purchased by residents of the contiguous United States at ClassicCookie.com. eGift Cards cannot be purchased with coupons, promotional offers and are not Ship & Save eligible. eGift Cards cannot be used to buy other gift cards or similar stored value products. You are limited to use of one Classic Cookie eGift Card per order. Except if disclosed in the eGift Card email or otherwise, Classic Cookie Gift Cards do not expire. There are no fees on any Classic Cookie Gift Cards. Gift Cards are not redeemable for cash, except where required by law in particular states. eGift Cards are not transferable from one Classic Cookie account to another. If a purchase exceeds your total Gift Card balance, the remaining amount must be paid with another payment method.
Purchase Limitations Unused eGift Cards may not be transferred. If you return merchandise originally purchased with an eGift Card, any refund will be issued to the Gift Card or in the form of another eGift Card. Any merchandise purchased with an eGift Card is subject to the applicable store or online return policies. Classic Cookie eGift Cards may be used as personal or business gifts, but may not be reloaded, resold, used for payment outside of www.classiccookie.com, or used by any third party in connection any marketing, advertising, or other promotional activities.
View Your Balance You can see the balance of your eGift card by going to the GIFT CERTIFICATES page at www.classiccookie.com. Under the ‘Check Gift Certificate Balance” section, you will be able to enter in the unique Gift Card Code you received with the gift card.
Returns You may not return or cancel your Classic Cookie eGift Card after activation. If you received a Gift Card because of a promotion where a purchase of a product is required and you subsequently return the qualifying product(s) or the order is otherwise cancelled prior to shipment, Classic Cookie may cancel the promotional eGift Card or deduct the value of the promotional eGift Card you received from the amount refunded to you upon return of the item.
Lost or Stolen eGift Cards If you suspect that someone has copied or stolen your eGift Card, contact 1-877-933-5444 immediately. eGift Cards will not be replaced if lost or stolen without proof of purchase. Only remaining balance on a lost or stolen eGift Card may be provided on a replacement eGift Card. eGift Cards have cash value and should be safeguarded accordingly. Promotional Cards will not be replaced under any circumstances.
Risk of Loss Ownership and risk of loss of an eGift Card passes to the purchaser as soon as Classic Cookie sends the eGift Card to the recipient email address designated by the purchaser. Mannon Specialty Foods, Inc. and Classic Cookie are not responsible for lost, stolen, or misdirected eGift Cards. It is the purchaser’s responsibility to provide a correct and updated email address for the recipient.
Customer Service If you need assistance with any aspect of your purchase, ownership, or use of your eGift Card, please contact 1-877-933-5444 or email Classic Cookie at email@example.com. Please refer to your order number, or be ready to supply your email address.
Delivery Information and Requirements for Gift Card Purchasers If you have concerns about your order and delivery of an eGift Card you have purchased, please contact 1-877-933-5444 or email Classic Cookie at firstname.lastname@example.org. Please refer to your order number or be ready to supply your email address. Mannon Specialty Foods, Inc. and Classic Cookie are not responsible for eGift Cards that are undeliverable or not received due to your failure to enter an accurate email address for the recipient. Please check to make sure the email address of the recipient is correct and contact 1-877-933-5444 if you suspect the recipient did not receive his/her eGift Card.
Reasons for Failed Delivery eGift Cards are delivered via email. If you have confirmed the recipient's email address but the eGift Card has not been viewed within a reasonable period after the requested delivery date, following is a list of the most common reasons why delivery may have failed:
1. Spam filter blocked email or routed it to a bulk/spam folder
2. Recipient's firewall blocked the email
3. Email inbox is over size limit
4. Invalid email address
If a spam filter is blocking Classic Cookie emails from getting to an inbox, the email options will need to be modified so that emails from email@example.com are not considered spam. If you need further assistance, contact 1-877-933-5444. Please refer to your order number or be ready to supply your email address.
Violation of These eGift Card Terms and Conditions You agree to not use Classic Cookie Gift Cards in any manner that is misleading, deceptive, unfair, or otherwise harmful to Mannon Specialty Foods, Inc., its affiliates including Classic Cookie, or their customers. We reserve the right, without notice to you, to void Gift Cards (including a portion of your Gift Card balance or particular Gift Card purchase) without a refund, suspend or terminate customer accounts, suspend or terminate the ability to use our services, cancel or limit orders, and bill alternative forms of payment if we suspect that a Gift Card is obtained, used, or applied to a Chewy account fraudulently, unlawfully, or otherwise in violation of these Chewy Gift Card Terms and Conditions.
Governing Law and Disputes You and Mannon Specialty Foods, Inc. hereby agree that any dispute relating in any way to a Classic Cookie eGift Card shall be resolved under the Law of the State of Tennessee.
Ship & Save
Ship & Save is a wonderful way for customers to get reoccurring orders of Classic Cookie products at a discounted price. This feature is only available to customers who sign up for a free Cookie Club account. You must register for this account, which includes providing certain information about yourself as prompted by our registration form. Please see our terms for a Cookie Club account to the left.
When you purchase product(s) on ClassicCookie.com and enroll in our Ship & Save program, you are signing up for continuous shipments of such products and may select how often you would like your product(s) delivered to you. You may change your periodic delivery schedule at any time (including on a one-time basis), as well as your shipping address, payment method, and products included in the program. Additionally, when you purchase certain products designated as “Ship & Save” eligible, and enroll in the Ship & Save program for such products, you will save an additional percentage on our everyday low prices
With Ship & Save, customers are only allowed the initial major discount once for their reoccurring order transaction. Once they have used that major discount, they are eligible for the smaller discount on every one of their orders that they have automatically placed with the program. This smaller discount is not applied to other non-reoccurring orders that the customer places. A customer has the right to cancel their Ship & Save subscription at any time. Once a customer cancels their subscription, they are not eligible for the Ship & Save discount on any future orders unless they get approval from Classic Cookie. Customers who abuse the Ship & Save method are subject to penalties as deemed fit by Classic Cookie.
Classic Cookie reserves the right to change Ship & Save benefits at any time in its sole discretion, including discount amounts and eligibility used to determine discount amounts; provided, however, Classic Cookie will not change the price of your next shipment once you have authorized an order as set forth in these Terms. Some of the offer details may change as you receive deliveries over time (for example, price, taxes, availability, shipping charges). Subscriptions are good while supplies last.
When you sign up for continuous shipments on Ship & Save, you will be required to expressly agree to permit us to charge your chosen payment method on a recurring basis, as well as the amount of the charge, which amount shall be set as described below. Classic Cookie will submit periodic charges (e.g. monthly) to your chosen payment method without further authorization from you, until you provide prior notice at any time that you wish to cancel or to change your payment method. Approximately 24 hours prior to your designated ship date, your order will be authorized, and a payment authorization hold will be placed on your chosen payment method. Once your order is processed, your payment method will be charged for the authorized amount. For clarification purposes only, a payment authorization hold is not an actual charge, i.e, if an authorization hold is placed for $49 on January 1 and your payment method is charged $49 on January 2 when your order is shipped, you will only see one actual charge on your payment method on January 2 for $49. An authorization hold may impact the amount of remaining credit available to you under your chosen payment method.
We may, in our sole discretion, change these Terms, (including all applicable terms, conditions, limitations and requirements on the ClassicCookie.com website), without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED PARTICIPATION AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR SUBSCRIPTIONS.
The charge for each Ship & Save item shipment will be billed to the payment method used to create your subscription or as otherwise directed by you. If we are unable to complete your Ship & Save order with the payment method you used to create your subscription, we will notify you and give you the opportunity to add another payment method in your account and to charge the payment method for your Ship & Save order.
Your subscription will remain in effect until it is cancelled. You can cancel at any time via your Cookie Club Account.
Classic Cookie cannot confirm the price of an item until you submit an order. If you use Ship & Save, the price of an item will be set at the time the order is processed. By confirming your purchase at the end of the checkout process, you agree to accept and pay for the Products as well as all shipping and handling charges and applicable taxes. Classic Cookie will collect and remit sales tax as required by law.
The receipt of an order number or an email order confirmation does not constitute the acceptance of an order or confirmation of an agreement to sell. Classic Cookie reserves the right, without prior notification, to limit the order quantity on any item and/or to refuse service to any customer. Verification of information may be required prior to the acceptance of an order. Prices andavailability of Products are subject to change without notice. Errors will be corrected when discovered and Classic Cookie reserves the right to revoke any stated offer and to correct any error, inaccuracy, or omission (including after an order has been submitted). Certain orders constitute improper use of the Site. Classic Cookie reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Your Classic Cookie account may also be restricted or terminated for any reason, at Classic Cookie's sole discretion.
In order to use certain features of our website, you must register for an account with Classic Cookie under the Cookie Club. When registering, you will be prompted to provide certain information about yourself. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information and update it as necessary; and(c) your use of our website does not violate any applicable law or regulation or these Terms.
You are responsible for maintaining the confidentiality of your Cookie Club Account login information. You are fully responsible for all activities that are associated with your Cookie Club Account (including but not limited to any purchases, posting reviews or other use of the Site). You agree to keep your username and password information confidential and not share it with anyone. You agree to immediately notify Cookie Club of any unauthorized use or suspected unauthorized use of your Cookie Club account or any other actual or potential breach of security.
Classic Cookie attempts to be as accurate as possible. However, Classic Cookie does not warrant that Product descriptions, depictions, colors, dimensions, ingredient lists or other content on the Site are accurate, complete, reliable, current or error-free. If a Product offered by Classic is not as described, your sole remedy is to return the Product. Call us at 1-877-933-5444 or send an email firstname.lastname@example.org for return information.
Products are made in conjunction with brands like Hershey’s, Reese’s, and Cinnabon. The HERSHEY’S trademark and trade dress on product packaging are registered trademarks of The Hershey Company. The REESE’S trademark and trade dress on product packaging are registered trademarks of The Hershey Company. CINNABON® AND THE Cinnabon logo are registered trademarks of Cinnabon LLC.
Acceptable Use Policy
In connection with your use of the Site and interactions with Classic Cookie and its employees and users, you agree not to collect, upload, transmit, display, communicate by email, telephone or electronically, or distribute any User Content (a) that violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy rights, right of publicity, or any other intellectual property or proprietary right; (b) that is unlawful, harassing, abusive, tortious, threatening, harmful, abusive, invasive of another's privacy, vulgar, defamatory, false, intentionally misleading, trade libelous, pornographic, obscene, patently offensive (e.g., material that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual) or otherwise objectionable material of any kind or nature or which is harmful to minors in any way; or (c) in violation of any law, regulation, or obligations or restrictions imposed by any third party.
In addition, you agree not to use the Site to: (a) upload, transmit, or distribute any computer viruses, worms, or any software intended to damage or alter a computer system or data; (b) send unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise; (c) harvest, collect, gather or assemble information or data regarding other users, including e-mail addresses, without their consent; (d) interfere with or disrupt servers or networks connected to the Site or violate the regulations, policies or procedures of such networks; (e) attempt to gain unauthorized access to the Site, other computer systems or networks connected to or used together with the Site, through password mining or other means; (f) harass or interfere with another user's use and enjoyment of the Site; (g) purchase Products for resale.
Risk of Loss and Shipping and Delivery
All items purchased from Classic Cookie are made pursuant to a shipment contract with a shipping carrier. This means that the risk of loss and title for such items pass to you upon delivery of the Products to the carrier. Products will be shipped to the address designated by you, if applicable, so long as such address is complete and complies with any shipping restrictions contained on our website. The time and location of delivery of the Products to you is at the discretion of the carrier.
Intellectual Property Rights
The Classic Cookie website contains valuable trademarks and service marks owner, controlled, or used by or licensed to Classic Cookie and Mannon Specialty Foods, Inc., including but not limited to, Classic Cookie, the Classic Cookie design logo, the tag line "oh my. goodness" and certain brands including HERSHEY’S®, REESE’S®, and CINNABON® (collectively, the "Marks"). Any use of the Marks without the prior written permission of Classic Cookie is strictly prohibited. The arrangement and layout of the Site including but not limited to, the Marks, images, text, graphics, buttons, screenshots, and other content or material are the sole and exclusive property of Classic Cookie.
UNAUTHORIZED COPYING, REPRODUCTION, MODIFYING, REPUBLISHING, UPLOADING, DOWNLOADING, POSTING, TRANSMITTING, MAKING DERIVATIVE WORKS OF OR DUPLICATING ALL OR ANY PART OF THE SITE IS PROHIBITED.
Other Users (Third Party Sites)
The Site may contain links to, or advertisements for, third party web sites (collectively, Third Party Sites") (for example, social media sites such as Facebook, YouTube, Twitter, Pinterest, TikTok, etc.). Such Third Party Sites are not under the control of Classic Cookie and Classic Cookie is not responsible for any Third Party Sites. Classic Cookie provides links to these Third Party Sites only as a convenience and does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third Party Sites. You agree that you use all Third Party Sites at your own risk. When you link to a Third Party Site, the applicable service provider's terms and policies, including privacy and data gathering practices govern. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any Third Party Site.
You hereby release us, our officers, employees, agents, affiliates, subsidiaries, parents, joint ventures, successors and any other companies under common control with us from claims, demands any and all losses, damages, rights, claims, and actions of any kind including personal injuries, death, and property damage, that are either directly or indirectly related to or arise out of any interactions with or conduct of other Site users or Third Party Sites.
Limitation on Liability
IN NO EVENT SHALL CHEWY, OUR OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUBSIDIARIES, PARENTS, JOINT VENTURES, SUCCESSORS AND ANY OTHER COMPANIES UNDER COMMON CONTROL WITH US, ANY INDEPENDENT CONTRACTORS, OR THIRD PARTY VETERINARIANS (“CLASSIC COOKIE”), BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFIT OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM OR IN ANY WAY RELATED TO YOUR RELATIONSHIP WITH CLASSIC COOKIE, YOUR USE OF THE SITE, PRODUCTS, OR THIRD PARTY SITES, OR YOUR INTERACTION WITH OR RELIANCE ON ANY ADVICE FROM ANY SUCH PERSON OR ENTITY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ACCESS TO, AND USE OF, THE SITE, PRODUCTS AND THIRD PARTY SITES AND ANY INTERACTIONS WITH OR RELIANCE ON ADVICE FROM ANY SUCH PERSON OR ENTITY ARE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE IN CONNECTION THEREWITH INCLUDING BUT NOT LIMITED TO YOUR COMPUTER SYSTEM OR LOSS OF DATA RESULTING THEREFROM. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR IN ANY WAY RELATED TO YOUR RELATIONSHIP WITH CLASSIC COOKIE, ANY INTERACTIONS WITH OR RELIANCE ON ADVICE FROM ANY SUCH PERSON OR ENTITY, OR THESE TERMS (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION), WILL AT ALL TIMES BE LIMITED TO THE GREATER OF (A) FIFTY US DOLLARS ($50) OR (B) AMOUNTS YOU'VE PAID CLASSIC COOKIE IN THE PRIOR 12 MONTHS. WE AGREE THAT ANY CLAIM BETWEEN US MUST BE BROUGHT WITHIN TWO (2) YEARS OF THE EVENT(S) GIVING RISE TO SUCH CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OF CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.
You agree to indemnify and hold Classic Cookie harmless, including costs and attorneys' fees, from any claim or demand made by any third party due to or arising out of (a) your use of the Site or Products, (b) your User Content, (c) your violation of these Terms, or (d) your interaction with such independent contractors or reliance on any advice provided by them. Classic Cookie reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Classic Cookie. Classic Cookie will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.
